1. Acceptance of Terms

By accessing or using mascoteer ("the Service"), you agree to be bound by these Terms of Service. If you do not agree to these terms, please do not use the Service. We reserve the right to update these terms at any time, and your continued use of the Service constitutes acceptance of any changes.

2. Description of Service

mascoteer is an AI-powered platform that allows users to generate unique mascot characters and animations from text descriptions. The Service includes mascot image generation, character animation, a public gallery, export tools, a developer API, and CLI/MCP integrations.

3. User Accounts

To use the Service, you must create an account using a valid email address or OAuth provider (Google, GitHub). You are responsible for:

• Maintaining the security of your account credentials
• All activity that occurs under your account
• Providing accurate and up-to-date account information

We reserve the right to suspend or terminate accounts that violate these terms.

4. Subscriptions & Credits

mascoteer offers subscription plans (Free, Hobby, Pro, Business) with varying features and credit allowances. Credits are used for mascot and animation generation.

• Subscription fees are billed monthly or yearly depending on your selected plan
• Credits are allocated per billing cycle and do not roll over to the next period unless stated otherwise
• Additional credits may be purchased separately as one-time top-ups
• Plan upgrades take effect immediately; downgrades take effect at the end of the current billing cycle

5. Payments & Refunds

All payments are processed securely through Stripe. By subscribing to a paid plan, you authorize us to charge your payment method on a recurring basis.

• All paid plans include a 7-day money-back guarantee. If you are unsatisfied, contact us within 7 days of your purchase for a full refund
• Refunds for credit top-ups are not available once credits have been used
• You may cancel your subscription at any time. Your access continues until the end of the current billing period

6. Intellectual Property & Content Ownership

Content generated through mascoteer is subject to the following terms:

• Your content: You retain ownership of the text prompts you submit. Subject to your subscription plan, you receive a license to use the generated mascot images and animations for personal or commercial purposes
• Free tier: Generated content may include a watermark. Removal of the watermark requires a paid plan
• Gallery content: By making your mascots or animations public in the gallery, you grant mascoteer a non-exclusive license to display them on the platform
• Our platform: The mascoteer platform, including its design, code, branding, and underlying technology, remains our intellectual property

7. Gallery & Public Content

The gallery allows users to share mascots and animations publicly. You are solely responsible for the content you make public. You must not publish content that is illegal, offensive, infringes on third-party rights, or violates these terms. We reserve the right to remove any gallery content at our discretion.

8. API Usage

mascoteer provides a developer API and CLI tools for programmatic access. API usage is subject to:

• Rate limits based on your subscription plan
• The same credit consumption as the web interface
• API keys must be kept confidential. You are responsible for any usage through your API keys
• We reserve the right to revoke API access for abusive or unauthorized usage

9. Prohibited Uses

You may not use the Service to:

• Generate content that is illegal, harmful, threatening, abusive, harassing, defamatory, or otherwise objectionable
• Infringe on the intellectual property rights of others
• Attempt to reverse-engineer, decompile, or extract the underlying AI models
• Circumvent usage limits, credits, or subscription restrictions
• Use automated means to scrape, crawl, or collect data from the Service beyond the provided API
• Resell, redistribute, or sublicense the Service without authorization

10. Service Availability & Changes

We strive to maintain the Service's availability but do not guarantee uninterrupted access. We may modify, suspend, or discontinue any part of the Service at any time. We will make reasonable efforts to notify users of significant changes in advance.

11. Limitation of Liability

To the maximum extent permitted by law, mascoteer and its operators shall not be liable for any indirect, incidental, special, consequential, or punitive damages arising from your use of the Service. Our total liability shall not exceed the amount you paid to us in the 12 months preceding the claim.

12. Termination

We may terminate or suspend your account at any time for violation of these terms. Upon termination, your right to use the Service ceases immediately. You may delete your account at any time through your account settings. Data deletion is handled in accordance with our Privacy Policy.

13. Changes to These Terms

We may update these Terms of Service from time to time. We will notify you of material changes by posting the updated terms on this page. Your continued use of the Service after changes are posted constitutes acceptance of the new terms.
